Rock & Ride der M.W.operates this store and website, including all related information, content, features, tools, products and services in order to provide you, the customer, with a curated shopping experience (the “Services”). Rock & Ride der M.W. is powered by Shopify, which enables us to provide the Services to you. The below terms and conditions, together with any policies referenced herein (these “Terms of Service” or “Terms”) describe your rights and responsibilities when you use the Services.

Your order is not accepted until Rock x Ride confirms acceptance. We must receive and process your payment before your order is accepted. Please review your order carefully before submitting, as Rock & Ride der M.W. may be unable to accommodate cancellation requests after an order is accepted. In the event that we do not accept, make a change to, or cancel an order, we will attempt to notify you by contacting the e‑mail, billing address, and/or phone number provided at the time the order was made. Your purchases are subject to return solely in accordance with our Refund Policy. You represent and warrant that your purchases are for your own personal or household use and not for commercial resale or export.
Section 4 - Prices and Billing
Prices, discounts and promotions are subject to change without notice. The price charged for a product or service will be the price in effect at the time the order is placed and will be set out in your order confirmation email. Unless otherwise expressly stated, posted prices do not include taxes, shipping, handling, customs or import charges. You represent and warrant that (i) the credit card information you provide is true, correct, and complete, (ii) you are duly authorized to use such credit card for the purchase, (iii) charges incurred by you will be honored by your credit card company, and (iv) you will pay charges incurred by you at the posted prices, including shipping and handling charges and all applicable taxes, if any.
Section 5 - Shipping and Delivery
We are not responsible for delivery delays caused by shipping carriers, customs procedures, or events beyond our reasonable control. Delivery times are estimates and not guaranteed. This does not affect your statutory rights in case of excessive delivery delays under applicable consumer protection laws.
Section 6 - Gift Cards
Gift cards can be purchased through our online store and may be used by the purchaser or transferred to another person. To redeem a gift card, the gift card code must be entered at checkout during the payment process. Gift cards are valid for a period of twelve (12) months from the date of purchase, unless a longer validity period is required by mandatory law. Gift cards cannot be exchanged for cash and cannot be refunded, except where required by applicable law. If an order paid with a gift card is refunded, the refunded amount will be credited back to the same gift card and can be used again within the original validity period. If an order was paid using both a gift card and another payment method, any refund will first be credited back to the gift card up to the amount originally paid with the gift card, and any remaining amount will be refunded to the original payment method used.

Rock x Ride is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our Store are made directly with Rock & Ride der M.W. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and Rock & Ride der M.W. , including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with Rock & Ride der M.W.

Rock & Ride der M.W. is the data controller responsible for the processing of your personal data in connection with the Services. We will cover the reasonable return shipping costs in this case. Minor errors that do not materially affect the contract do not give us the right to cancel confirmed orders, in accordance with applicable consumer protection laws.

Nothing in this section limits or affects your statutory rights as a consumer.

You may not transfer or assign your rights or obligations under these Terms to another person without our prior written consent, unless such transfer is permitted by mandatory law. We may transfer or assign our rights and obligations under these Terms to another company in connection with a business transfer, restructuring, or sale of the business, provided that this does not reduce your rights under these Terms or under applicable consumer protection laws. In such cases, your contractual rights and obligations will continue to apply to the new operator of the Services.

These Terms and any separate agreements whereby we provide you with Services shall be governed by and construed in accordance with the laws of Italy, without regard to its conflict of law provisions. If you are a consumer residing in the European Union, this choice of law does not deprive you of the protection afforded to you by mandatory consumer protection laws of your country of residence. For customers who are not consumers within the meaning of EU consumer protection laws (for example, business customers), the exclusive place of jurisdiction for all disputes arising from or in connection with these Terms and the use of the Services shall be the competent courts at the registered office of Rock & Ride der M.W. in Italy. The application of the United Nations Convention on Contracts for the International Sale of Goods (CISG) is excluded.
